Great news for Ohio, Senate Bill 120The tyranny of the anti-smoking majority A round of applause, please, and -- what the heck -- a standing ovation, too, for the Gladstone City Council. That suburban community's elected leaders appear on the brink of overthrowing the tyranny of the anti-smoking majority and approving what might be the metro area's fairest and most sensible smoking ban. It is one that reasonable minds on both sides should be able to live with -- albeit the non-smokers a little longer. The Kansas City Star's bi-weekly Northland Neighborhood News reported Saturday the measure could be approved as soon as Feb. 9 and be effect in 60 days. Notable exceptions to its ban on public and workplace smoking include billiard halls and bowling alleys, as well as taverns and restaurants that seat fewer than 75 patrons, provided signs are posted announcing: "Non-smoking areas are not available." Also, any business with a liquor license operating in the city on Jan. 1 that customarily had allowed smoking would be grandfathered in to allow the practice so long as that business remained under the same ownership. That last provision sets Gladstone's proposed law in a class by itself in common sense and fairness. In Kansas City and in an ever-increasing number of suburbs where blanket smoking bans have been imposed, neighborhood tavern owners and others have had the proverbial rug pulled out from under them. Their generations-old business models crumbled as their smoking-patron regulars fled. It simply was not fair. All that these mostly mom-and-pop entrepreneurs wanted was the right to run their places of business -- their livelihoods --as they saw fit, to have a choice to be a smoking or non-smoking neighborhood watering hole, pool hall, barber shop or whatever. For many that freedom of choice was stripped away. The mindset among an increasing number of public servants insists on nanny-state uniformity that bans tobacco use on any premises where any member of the general public might someday step foot. Now, at long last, wiser minds somewhere have found no offense in a dual economy where smoking and non-smoking establishments shall be allowed to co-exist. Gladstone council member Les Smith gets it. The Star reports he told fellow council members that second-hand smoke does not become a public health issue until someone walks through a door and makes it one. "It is really simple," he said. "You have a choice not to go in." Quitting smoking is not always the best advice......especially if your new crutch is Chantix
An acquaintance writes about his success in quitting smoking.......though the health effect outcome was less than desirable.....So I quit smoking using a new drug by the name of "Chantix"; the stuff blocks the nicotine receptors in the brain, not sure how it works...So late last week I started getting thirsty. .......Then it started getting worse, I would wake up in the night to go, and thirstier than I've ever been in my life, my mouth was so dry I started getting sores on my tongue.....decided to call the nurse "on call". After telling her the symptoms she said come into the ER now. I mean NOW....".....sounds like high blood sugar......."So what is normal then” and she says "80 to 140". "So what is my number?” I asked again, and she answers "Um I'm not sure" Frustrated I ask, "What does the damn machine read?" I don't know, this machine only goes to 500, then it just blinks, critically high ... critically high..........They run all the tests to be sure, but yup, I'm a diabetic now....... According to this website reporting the side effects of Chantix comes this ominous warning:Following is a list of treatment-emergent adverse events reported by patients treated with CHANTIX during all clinical trials......METABOLISM AND NUTRITION DISORDERS. Infrequent: Diabetes mellitus, Hyperlipidemia, Hypokalemia. Rare: Hyperkalemia, Hypoglycemia......Coincidence????........ Hopefully for Sequel, the negative side effects of Chantix are temporary......I know if I had to chose, I'd take smoking over diabetes.......but that's just me. Ohio's smoking ban is devastating liquor permit-holding establishments. The ballot language at the polls in 2006, in black and white, claimed exemptions for family-owned businesses and private clubs. Name just three. Liquor permit holders lost the potential of $67.44 million in liquor sales alone in 2007. The same time frame shows home consumption increased by more than 1.3 million bottles; proof positive that smokers refuse to patronize places that do not cater to them while the anti-smokers never replaced the smokers, as was promised. Gongwer News Service in August reported Ohio's highest unemployment since 1992 with the hospitality and leisure industries at No. 1 in losses, beating trade, utilities, and transportation combined. And the Ohio Department of Health created a policy in direct conflict with the law that "merely smoking in a prohibited area does not constitute a violation." According to the ODH, not one solitary smoker has been fined since enforcement began. County boards of health refuse to approach or fine a smoker. This law was bad from the beginning, from its bait-and-switch ballot language to the ruling that a smoker is not violating the law. How many more of our doors must close before our legislature amends this law? Shame on Governor Strickland, Ohio Legislators for Breaking Promise to Protect Kids from Tobacco
WASHINGTON, April 8, 2008 /PRNewswire-USNewswire/ -- The following is astatement from Matthew L. Myers, President, Campaign for Tobacco-Free Kids: Governor Ted Strickland and Ohio legislators have abandoned Ohio's kids and put the state's health at risk with their underhanded actions today toraid funds from the Ohio Tobacco Prevention Foundation. This decision will guarantee that for years to come more Ohio children will become addicted totobacco, more Ohio citizens will die prematurely from tobacco use, and all Ohio taxpayers will foot the bill for higher health care costs. This will be the shameful legacy of Governor Strickland, Senate President Bill Harrisand House Speaker Jon Husted unless they reverse course. It is actions like this that feed public distrust of government. In1998, Ohio's leaders made a public commitment to use a portion of the hundreds of millions of dollars the state would receive under the state tobacco settlement to prevent kids from smoking and help smokers quit.Today's decision by Governor Strickland and the Legislature to raid theOhio Tobacco Prevention Foundation's fund of $190 million dollars breaks that promise. They have acted with no opportunity for public input, little debate and on the basis of decisions made behind closed doors. Unless this decision is reversed, today will be a dark day for Ohio's kids and the state's health.

Fighting to ensure that government enforcement does not infringe upon the freedoms of individuals and the justice of a market economy.
On November 7, 2006, the voters of Ohio went to polls and faced two separate issues on the ballot addressing how Ohio would take steps to limit smoking in public places. These special issues shared the goal of improving the health of Ohioans by limiting public exposure to second hand smoke. They differed greatly in how each of the proposals would be implemented and how the language used on the ballot could be interpreted to create health codes, enforcement protocol and decisions regarding jurisdictions and penalties. These differences were subtle hidden in the misleading language that voters were presented with on their ballot.
